The bill on lifting the ban on the Taliban in the Russian Federation adopted by the Duma in the first reading
At a session on Tuesday, the State Duma adopted in the first reading a bill that allows excluding the Taliban movement from the list of banned organizations in Russia.
The authors of the draft law are a group of parliament members, including senators Andrei Klishas, Andrei Yatskin and Yuri Fyodorov, as well as MPs Vasily Piskarev, Andrei Lugovoy, and Dmitry Vyalkin.
According to the bill, "the ban on the activities of an organization included in the unified federal list of organizations, including foreign and international organizations recognized as terrorist in accordance with Russian legislation, may be temporarily suspended by a decision of a Russian court based on an application by the Prosecutor General of the Russian Federation or his deputy, if there is evidence that such an organization, after being included in the said list, has ceased carrying out activities aimed at promoting, justifying and supporting terrorism."
Presently, Russian legislation does not provide for a mechanism allowing for the suspension of the ban on the activities of such an organization. The amendments proposed by the bill are aimed at eliminating the designated legal gap.
After the court decision comes into legal force, the accompanying changes will be made to the list of terrorist organizations, the draft law suggests.
The draft law also provides for corresponding changes to the Code of Administrative Procedure of the Russian Federation (with regards to determining the procedure for proceedings on administrative cases on the temporary suspension of the ban on the activities of an organization included in the list of terrorist organizations), as well as to the Federal Law of August 7, 2001 No. 115-FZ "On Combating the Legalization (Laundering) of Criminally Obtained Proceeds and the Financing of Terrorism" (with regards to specifying the grounds for excluding an organization or individual from the list of organizations and individuals who are known to be involved in extremist activity or terrorism.)
